นโยบายความเป็นส่วนตัว (Privacy Policy)

บริษัท จ็อบแคน (ประเทศ) จำกัด ( “บริษัท” )มุ่งมั่นที่จะปกป้องความเป็นส่วนตัวของลูกค้า ผู้ใช้บริการ คู่ค้า พันธมิตรทางการค้า ผู้มาติดต่อ ไม่ว่าจะเป็นการเก็บรวบรวม ใช้ และ/หรือเปิดเผย (“การประมวลผลข้อมูล” ) เพื่อให้เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 บริษัทจึงออกประกาศฉบับนี้เพื่อแจ้งข้อมูลแก่ท่านอันเกี่ยวกับสิทธิและหน้าที่ ตลอดจนเงื่อนไขต่างๆ ในการเก็บ รวบรวมใช้ และเปิดเผยข้อมูลส่วนบุคคล

Jobcan (Thailand) Co.,Ltd. (“Company” ) are committed to protecting the privacy of our customers, service used, business partners, visitors, whether collection, using and/or disclosing them (collectively referred to as ( “Data Processing”) in order to comply with the Personal Data Protection Act B.E 2562. Thus, the company issues this policy to inform of data about rights and duties as well as various conditions for collecting, using, and disclosing personal data.

ข้อมูลส่วนบุคคล (Personal Data)

“ข้อมูลส่วนบุคคล” ในการเก็บรวบรวม และเก็บรักษาข้อมูลส่วนบุคคล บริษัทจะใช้วิธีการที่ชอบด้วยกฎหมายและจำกัดเพียงเท่าที่จำเป็นตามวัตถุประสงค์การดำเนินการของบริษัท อันประกอบด้วย
“Personal Data” Which collecting and keeping personal data, the company will use lawful means and only limited to the extent necessary for the company’s operating objectives which consist of

● ข้อมูลส่วนบุคคล เช่น ชื่อ นามสกุล, วันเดือนปีเกิด, อายุ, สัญชาติ, เลขบัตรประจำตัวประชาชน, ลายมือชื่อ ● Personal data such as name-surname, date of birth, age, nationality, national identification number, signature.

● ข้อมูลสำหรับการติดต่อ เช่น ที่อยู่, หมายเลขโทรศัพท์, อีเมล
Contact information such as address, telephone number, Email.

● ข้อมูลทางการเงิน เช่น สำเนาสมุดบัญชีธนาคาร, เลขบัตรเครดิต
Financial information such as a copy of bank passbook, credit number.

● ข้อมูลที่ได้จากการเก็บรวบรวมของบริษัท หรือระบบอัตโนมัติจากบริการหรืออุปกรณ์ต่างๆ ของบริษัท เช่น หมายเลข IP Address, Cookies, พฤติกรรมการใช้บริการ, ประวัติการใช้งานบริการ, ภาพถ่าย
Data collected by the company or automated system from the company’s devices such as IP address, cookies, service behavior, order history, photos, images.

โดยบริษัทจะดำเนินการเก็บรวบรวมข้อมูลส่วนบุคคลเมื่อได้รับความยินยอมจากเจ้าของข้อมูลส่วนบุคคลก่อน ยกเว้นในกรณีดังต่อไปนี้
The company will collect personal data with the consent of the personal data subject except in the following cases:

● เพื่อปฏิบัติตามสัญญา กรณีการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลเพื่อความจำเป็นต่อการให้บริการหรือปฏิบัติตามสัญญาระหว่างเจ้าของข้อมูลและบริษัท
To comply with the contract in the case of collecting, using, or disclosing personal data for the purposes of providing services or complying with the contract. between the data subject and the company.

● เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพ
To prevent or support danger to life, body, or health.

● เพื่อปฏิบัติตามกฎหมาย
To comply with the law.

● เพื่อผลประโยชน์อันชอบด้วยกฎหมายของบริษัท กรณีมีความจำเป็นเพื่อประโยชน์อันชอบธรรมในการดำเนินงานของบริษัท โดยบริษัทจะพิจารณาถึงสิทธิของเจ้าของข้อมูลเป็นสำคัญ เช่น เพื่อป้องกันการฉ้อโกง การรักษาความปลอดภัยในระบบเครือข่าย การปกป้องสิทธิเสรีภาพ และประโยชน์ของเจ้าของข้อมูล เป็นต้น
For the legitimate interests of the company in case of necessary for the legitimate interests of the company’s operations, the company will consider the right of the data subject as a priority such as for fraud prevention, network security protection of freedom, and the benefit of the owner of the data, etc.

● เพื่อการศึกษาวิจัยหรือสถิติ กรณีที่มีการจัดทำเอกสารประวัติศาสตร์หรือจดหมายเหตุเพื่อประโยชน์สาธารณะหรือที่เกี่ยวกับการศึกษาวิจัยหรือสถิติซึ่งได้จัดให้มีมาตรการปกป้องที่เหมาะสมเพื่อคุ้มครองสิทธิและเสรีภาพของเจ้าของข้อมูล
For research studies or statistics in the case of historical documents for the public benefit or those related to research or statistics which provide appropriate safeguards to protect the rights and freedom of data subjects.

● เพื่อปฏิบัติภารกิจของรัฐ กรณีที่ความจำเป็นต่อการปฏิบัติตามภารกิจเพื่อประโยชน์สาธารณะ หรือการปฏิบัติหน้าที่ตามอำนาจรัฐที่บริษัทได้รับมอบหมาย
To perform state mission in the event that it is necessary to carry out the mission for the public interest or the performance of duties under the power of the state that the company has been assigned.

แหล่งที่มาของข้อมูล (Data Source)

● ได้รับจากเจ้าของข้อมูลโดยตรงที่ท่านได้ให้ไว้ในกิจกรรมต่างๆ เช่น การใช้บริการ, การเข้าร่วมกิจกรรมส่งเสริมการขาย, การสมัครสมาชิก, เข้าร่วมกิจกรรมทางการตลาด, เก็บข้อมูลสำหรับผู้ติดต่อบริษัท
Receive directly from the data subject that has been provided in activities such as participating in promotional activities for membership subscribing to data and participating in marketing activities, and storing data for office.

● ข้อมูลจากระบบการให้บริการ เช่น ชื่อ-นามสกุล, ภาพถ่าย, ลายพิมพ์นิ้วมือ
Data from automated systems, such as name-surname, images, fingerprints.

● ข้อมูลจากแหล่งอื่น เช่น ข้อมูลสาธารณะ, หน่วยงานพันธมิตร, บริษัทในเครือ
Data from other sources, such as public data, partner agencies, or affiliated companies.

วัตถุประสงค์ในการประมวลข้อมูลส่วนบุคคล (Purpose of Processing Personal Data)

บริษัทอาจนำเข้าข้อมูลส่วนบุคคลไปใช้ตามวัตถุประสงค์ดังต่อไปนี้หรือตามวัตถุประสงค์อื่นๆ ที่แจ้งขณะเก็บรวบรวมข้อมูลหรือที่ท่านได้ให้ความยินยอมหลังจากบริษัทดำเนินการเก็บข้อมูลไปแล้ว
The company may use personal data for the following purposes or the other purpose notified at the time of collecting the data or for which you have given consent after the company has collected the data:

● เพื่อเข้าทำสัญญา หรือปฏิบัติหน้าที่ตามสัญญาระหว่างเจ้าของข้อมูลกับบริษัท หรือปฏิบัติหน้าที่ตามสัญญาระหว่างบริษัทกับบุคคลภายนอกเพื่อประโยชน์ของเจ้าของข้อมูล
To enter into a contract or perform duties the contract between the company and the data subject or perform duties under contracts between the company and third parties for the benefit of the data subject.

● เพื่อตอบคำถามและให้ความช่วยเหลือแก่เจ้าของข้อมูล
To answer questions and provide assistance to data subjects.

● เพื่อพัฒนาและปรับปรุงบริการของบริษัทให้ตอบสนองต่อความต้องการของเจ้าของข้อมูลมากยิ่งขึ้น
To develop and improve the company’s products and services to better respond to the needs of the data subjects.

● เพื่อให้ข้อมูลและแนะนำสินค้า ผลิตภัณฑ์ การบริการ และ/หรือประชาสัมพันธ์ทางการตลาด รายการส่งเสริมการขาย หรือสิทธิประโยชน์ผ่านช่องทางการติดต่อที่ได้รับจากเจ้าของข้อมูล ตามที่เจ้าของข้อมูลได้ให้ความยินยอม
To provide data and recommend products, services. and/or public relations for marketing campaigns or benefits through contact channels received from the data subject as the data subject has given consent.

● เพื่อสำรวจความคิดเห็น วิเคราะห์ การทำวิจัย และจัดทำข้อมูลทางสถิติเพื่อใช้ทางการตลาด หรือการพัฒนาและปรับปรุงการดำเนินกิจการของบริษัทตามที่เจ้าของข้อมูลได้ให้ความยินยอม
For survey opinions, analysis and conduct research for the marketing or the development and improvement of the company’s operations as the subject has given consent.

● เพื่อประโยชน์ในการบริการจัดการงานหรือดำเนินงานภายใต้ของบริษัทที่จำเป็นภายใต้ประโยชน์โดยชอบด้วยกฎหมาย
For the benefit of administering or operating the company’s internal operations necessary under the legitimate interest.

● เพื่อตรวจสอบ กำกับดูแล และรักษาความปลอดภัยบริเวณอาคารหรือสถานที่ของบริษัท
To inspect, supervise, and secure the company’s buildings or premises.

● เพื่อการปฏิบัติตามกฎหมายที่เกี่ยวข้องกับการดำเนินงานของบริษัท เช่น การหักภาษี ณ ที่จ่าย
To comply with laws related to the operations of the company, such as withholding tax.

● เพื่อให้ข้อมูลแก่หน่วยงานของรัฐที่มีอำนาจตามกฎหมายที่หน่วยงานภาครัฐร้องของ เช่น สำนักงานตำรวจแห่งชาติ สำนักงานป้องกันและปราบปรามการฟอกเงิน กรมสรรพากร ศาล
To provide data to government agencies with statutory authority as requested by government agencies such as the National Police Anti-Money Laundering Office, Revenue Department, as well as Courst.

● เพื่อดำเนินกิจกรรมใดๆ ทางบัญชีและการเงิน เช่น การตรวจสอบบัญชี การแจ้งและเรียกเก็บหนี้ การใช้สิทธิสวัสดิการต่างๆ ภาษี และหลักฐานการดำเนินธุรกรรมต่างๆ ที่กฎหมายกำหนด
To carry out any accounting and financial activities such as auditing accounts, notification, and collection of debt, the exercise of various welfare rights, taxes, and evidence of transactions as required by law.

● เพื่อประโยชน์ในการสอบสวนและปฏิบัติตามกฎหมาย ข้อบังคับ ระเบียบ หรือหน้าที่ตามกฎหมายของบริษัท
For the legitimate interest of the company, such as recording complaints via the call center system.

● ใช้ข้อมูลในการยืนยันตัวตนของลูกค้า

● วัตถุประสงค์อื่นๆ ที่ได้รับคำยินยอมชัดแจ้งจากท่าน

การส่งต่อและเปิดเผยข้อมูลส่วนบุคคล (Transmission and Disclosure of Personal Data)

บริษัทจะไม่เปิดเผยและส่งต่อข้อมูลส่วนบุคคลของท่านไปยังหน่วยงานภายนอก เว้นแต่ได้รับคำยินยอมอย่างชัดแจ้งจากท่านหรือเป็นไปตามกรณีดังต่อไปนี้
The company will not disclose or forward your personal data to outside parties except with your consent or in accordance with the following cases

● เพื่อบรรลุวัตถุประสงค์ตามที่ระบุในนโยบายข้อมูลส่วนบุคคลฉบับนี้ บริษัทอาจจำเป็นต้องเปิดเผยหรือแบ่งปันข้อมูลเฉพาะเท่าที่จำเป็นแก่คู่ค้า ผู้ให้บริการ หรือหน่วยงานภายนอก เช่น การให้บริการด้านเทคโนโลยีสารสนเทศ, บริการบันทึกข้อมูล, บริการตรวจสอบบัญชี, บริการชำระเงิน, บริการรับส่งไปรษณีย์, บริการรับส่งพัสดุ, บริการจัดพิมพ์, บริการประกันภัย, บริการวิเคราะห์ข้อมูล, บริการการทำวิจัย การทำการตลาด, หรือบริการอื่นใดที่อาจเป็นประโยชน์ต่อท่าน หรือเกี่ยวกับการดำเนินธุรกิจของบริษัท โดยบริษัทจะทำข้อตกลงการประมวลข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด
To achieve the purpose stated in the Privacy Policy, the company may be required to disclose or share as necessary data with partners, services providers, or external entities, such as providing data technology services, data recording, printing service, insurance service, data analysis service, parcel research services, marketing or any other service that may be of interest to you or related to the company’s business operations, etc. The company will enter into a personal data processing agreement as required by law.

The company will take technical measures and appropriate management to protect and secure your personal data as it provides encryption for transmitting data over the internet and controls access to your personal data only for those involved in the part of the data stored in the form of documents and electronics.

ระยะเวลาในการจัดเก็บข้อมูล (Storage Duration)

บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้ตลอดระยะเวลาตราบเท่าที่จำเป็นต่อการประมวลผลตามวัตถุประสงค์ในนโยบายฉบับนี้เท่านั้น เว้นแต่มีความจำเป็นต้องเก็บข้อมูลส่วนบุคคลไว้ด้วยเหตุอื่นใด เช่น เพื่อปฏิบัติตามกฎหมายหรือการตรวจสอบกรณีการเกิดข้อพิพาท บริษัทอาจมีความจำเป็นต้องเก็บข้อมูลไว้เป็นระยะเวลาเกินกว่าที่ระบุ
